FROM: Rod J Rosenstein
SUBJECT: Restoring public confidence in the FBI
The Federal Bureau of Investigation has long been regarded as our nation's premier federal investigative agency. Over the past year, however, the FBI's reputation and credibility have suffered substantial damage, and it has affected the entire Department of Justice. That is deeply troubling to many Department employees and veterans, legislators and citizens.
ADVERTISEMENT

The current FBI Director is an articulate and persuasive speaker about leadership and the immutable principles of the Department of Justice. He deserves our appreciation for his public service. As you and I have discussed, however, I cannot defend the Director's handling of the conclusion of the investigation of Secretary Clinton's emails, and I do not understand his refusal to accept the nearly universal judgment that he was mistaken. Almost everyone agrees that the Director made serious mistakes; it is one of the few issues that unites people of diverse perspectives.

The director was wrong to usurp the Attorney General's authority on July 5, 2016, and announce his conclusion that the case should be closed without prosecution. It is not the function of the Director to make such an announcement. At most, the Director should have said the FBI had completed its investigation and presented its findings to federal prosecutors. The Director now defends his decision by asserting that he believed attorney General Loretta Lynch had a conflict. But the FBI Director is never empowered to supplant federal prosecutors and assume command of the Justice Department. There is a well-established process for other officials to step in when a conflict requires the recusal of the Attorney General. On July 5, however, the Director announced his own conclusions about the nation's most sensitive criminal investigation, without the authorization of duly appointed Justice Department leaders.
What was Clinton FBI probe about?

Compounding the error, the Director ignored another longstanding principle: we do not hold press conferences to release derogatory information about the subject of a declined criminal investigation. Derogatory information sometimes is disclosed in the course of criminal investigations and prosecutions, but we never release it gratuitously. The Director laid out his version of the facts for the news media as if it were a closing argument, but without a trial. It is a textbook example of what federal prosecutors and agents are taught not to do.

In response to skeptical question at a congressional hearing, the Director defended his remarks by saying that his "goal was to say what is true. What did we do, what did we find, what do we think about it." But the goal of a federal criminal investigation is not to announce our thoughts at a press conference. The goal is to determine whether there is sufficient evidence to justify a federal criminal prosecution, then allow a federal prosecutor who exercises authority delegated by the Attorney General to make a prosecutorial decision, and then - if prosecution is warranted - let the judge and jury determine the facts. We sometimes release information about closed investigations in appropriate ways, but the FBI does not do it sua sponte.

Concerning his letter to the Congress on October 28, 2016, the Director cast his decision as a choice between whether he would "speak" about the FBI's decision to investigate the newly-discovered email messages or "conceal" it. "Conceal" is a loaded term that misstates the issue. When federal agents and prosecutors quietly open a criminal investigation, we are not concealing anything; we are simply following the longstanding policy that we refrain from publicizing non-public information. In that context, silence is not concealment.

My perspective on these issues is shared by former Attorneys General and Deputy Attorneys General from different eras and both political parties. Judge Laurence Silberman, who served as Deputy Attorneys General under President Ford, wrote that "it is not the bureau's responsibility to opine on whether a matter should be prosecuted." Silberman believes that the Director's "Performance was so inappropriate for an FBI director that [he] doubt[s] the bureau will ever completely recover." Jamie Gorelick, Deputy Attorney General under President George W. Bush, to opine that the Director had "chosen personally to restrike the balance between transparency and fairness, department from the department's traditions." They concluded that the Director violated his obligation to "preserve, protect and defend" the traditions of the Department and the FBI.

Former Attorney General Michael Mukasey, who served under President George W Bush, observed the Director "stepped way outside his job in disclosing the recommendation in that fashion" because the FBI director "doesn't make that decision". Alberto Gonzales, who also served as Attorneys General under President George W Bush, called the decision "an error in judgement." Eric Holder, who served as Deputy Attorneys General under President Clinton and Attorneys General under President Obama, said that the Director's decision "was incorrect. It violated long-standing Justice Department policies and traditions. And it ran counter to guidance that I put in place four years ago laying out the proper way to conduct investigations during an election season." Holder concluded that the Director "broke with these fundamental principles" and "negatively affected public trust in both the Justice Department and the FBI".
Former Deputy Attorneys General Gorelick and Thompson described the unusual event as "real-time, raw-take transparency taken to its illogical limit, a kind of reality TV of federal criminal investigation," that is "antithetical to the interests of justice".

Donald Ayer, who served as Deputy Attorneys General under President HW Bush, along with former Justice Department officials, was "astonished and perplexed" by the decision to "break[] with longstanding practices followed by officials of both parties during past elections." Ayer's letter noted, "Perhaps most troubling… is the precedent set by this departure from the Department's widely-respected, non-partisan traditions."

We should reject the departure and return to the traditions.

Although the President has the power to remove an FBI director, the decision should not be taken lightly. I agree with the nearly unanimous opinions of former Department officials. The way the Director handled the conclusion of the email investigation was wrong. As a result, the FBI is unlikely to regain public and congressional trust until it has a Director who understands the gravity of the mistakes and pledges never to repeat them. Having refused to admit his errors, the Director cannot be expected to implement the necessary corrective actions.

Then-FBI Director James Comey knew that a critical piece of information relating to the investigation into Hillary Clinton's email was fake -- created by Russian intelligence -- but he feared that if it became public it would undermine the probe and the Justice Department itself, according to multiple officials with knowledge of the process.

As a result, Comey acted unilaterally last summer to publicly declare the investigation over -- without consulting then-Attorney General Loretta Lynch -- while at the same time stating that Clinton had been "extremely careless" in her handling of classified information. His press conference caused a firestorm of controversy and drew criticism from both Democrats and Republicans.

Comey's actions based on what he knew was Russian disinformation offer a stark example of the way Russian interference impacted the decisions of the highest-level US officials during the 2016 campaign.

The Washington Post reported Wednesday that this Russian intelligence was unreliable. US officials now tell CNN that Comey and FBI officials actually knew early on that this intelligence was indeed false.

In fact, acting FBI Director Andrew McCabe went to Capitol Hill Thursday to push back on the notion that the FBI was duped, according to a source familiar with a meeting McCabe had with members of the Senate intelligence committee.

The Russian intelligence at issue purported to show that then-Attorney General Lynch had been compromised in the Clinton investigation. The intelligence described emails between then-Democratic National Committee Chair Debbie Wasserman Schultz and a political operative suggesting that Lynch would make the FBI investigation of Clinton go away.

In classified sessions with members of Congress several months ago, Comey described those emails in the Russian claim and expressed his concern that this Russian information could "drop" and that would undermine the Clinton investigation and the Justice Department in general, according to one government official.

Still, Comey did not let on to lawmakers that there were doubts about the veracity of the intelligence, according to sources familiar with the briefings. It is unclear why Comey was not more forthcoming in a classified setting.

Sources close to Comey tell CNN he felt that it didn't matter if the information was accurate, because his big fear was that if the Russians released the information publicly, there would be no way for law enforcement and intelligence officials to discredit it without burning intelligence sources and methods. There were other factors behind Comey's decision, sources say.
In at least one classified session, Comey cited that intelligence as the primary reason he took the unusual step of publicly announcing the end of the Clinton email probe.

In that briefing, Comey did not even mention the other reason he gave in public testimony for acting independently of the Justice Department -- that Lynch was compromised because Bill Clinton boarded her plane and spoke to her during the investigation, these sources told CNN.
Multiple US officials tell CNN that to this day Russia is trying to spread false information in the US -- through elected officials and American intelligence and law enforcement operatives -- in order to cloud and confuse ongoing investigations.

It’s so far in the weeds and doesn’t directly implicate or exonerate Trump. So I suspect it may somehow not get the attention it deserves. But the new report from the Post that James Comey’s decision to announce the Clinton “no charges” decision on his own in July 2016 may itself have been the product of a successful Russian disinformation campaign is simply remarkable.

For almost a year we’ve understood that the main reason James Comey chose to announce his recommendation not to bring charges against Hillary Clinton on his own was tied in significant part to that tarmac meeting between Attorney General Loretta Lynch and Bill Clinton. Early this month we learned that in a Russian hacked email cache the FBI had also found a letter that, while ambiguous, seemed to suggest that Lynch had agreed to go easy on Clinton.

That too figured into Comey’s decision. And the impact of the tarmac meeting may only have been so great because of the earlier email.

At least as I recall this new detail, the email was ambiguous but enough to make the FBI worry that if it subsequently came out in a Wikileaks email dump it could bring Lynch’s independence into question.

Now this new story tells a very different story. The email appears to be much more specific, suggesting that Lynch had given her assurance that she wouldn’t let the probe go too far. But that’s not the big news: it now appears to be the consensus opinion in the FBI and intelligence community that the email is in fact fraudulent, presumably a fake document woven into a trove of genuine documents with the aim of having it be found by the FBI and trigger something just like what in fact happened. Notably, the apparently fraudulent email never appeared in any of the document dumps during the course of the election. It only seems to have dropped directly into the FBI’s hands.

There is a lot here that is unclear, a lot left to supposition. But fraudulent documents get woven into caches of genuine documents for specific reasons, sometimes merely to sow confusion, more often to trigger specific actions. Remember, the Niger Uranium forgeries which played such a notorious role in the lead up to the Iraq War and controversies lasting long after it were in fact forgeries included in a batch of genuine documents. Some dissenting sources suggest that the phony email didn’t play much role in Comey’s decision. It only got pulled in as an ex-post facto explanation once Comey’s decision-making came into question. (Even if true, that in itself would be a highly disturbing development.) Regardless, the idea that the FBI and James Comey himself could have been punked by such an operation and taken such consequential actions on the basis of it is simply astonishing.

The FBI declined to hand over memos regarding former FBI Director James Comey's communications with President Trump to the House Oversight Committee Thursday, and said it needs more time to evaluate how the special counsel investigation into possible collusion between Trump's campaign and Russia affects the committee's request for information.

In a letter released Thursday, Assistant Director Gregory Brower, in the FBI's Office of Congressional Affairs, told committee chairman Rep. Jason Chaffetz the special counsel investigation means more "consultation" is needed before any documents are released.

"In light of this development and other considerations, we are undertaking appropriate consultation to ensure all relevant interests implicated by your request are properly evaluated," Brower wrote. "We will update this response as soon as possible."

Chaffetz's original deadline for the documents was May 24, one day before Brower responded.

Chaffetz, R-Utah, and Rep. Elijah Cummings, the top Democrat on the committee, asked the FBI for any internal memos concerning contact between Trump and Comey. It's been reported that Comey kept detailed notes of his conversations with Trump, including reported conversations when Trump asked Comey to stop investigating potential ties between his campaign and The Kremlin.

Chaffetz wrote in a response letter to Acting FBI Director Andrew McCabe that his committee doesn't want to interfere with the special counsel's investigation. Instead, he pictures the committee's investigation being complementary to the work that former FBI Director Robert Mueller is doing. Mueller is the special counsel who was appointed to lead the investigation.

The Utah Republican noted that Mueller's investigation will have to take place outside of the public eye because it's a criminal investigation. However, Chaffetz wants his to take place in public because the American people need to know the facts of the case.

Chaffetz asked the FBI to provide documents that he said are outside the scope of the special counsel's investigation. Those include communications between Comey and any White House employee, including the president and vice president, between Sept. 4, 2013, and his dismissal. He also asked to get all communications between Comey and the attorney general or deputy attorney general in that same time frame.

"I am seeking to better understand Comey's communications with the White House and attorney general in such a way that does not implicate the special counsel's work," he said.

He added, "Congress and the American public have a right and a duty to examine this issue independently of the special counsel's investigation. I trust and hope you understand this and make the right decision — to produce these documents to the committee immediately and on a voluntary basis."
